I understand that signing a mutual consent divorce deed before notary has no legal value. But what if the deed was also signed by witnesses (two)? Does that make any difference? Also, does it make any difference if the wife's surname was never changed in any of the document after marriage, nor did she sign any other documents (property ownership papers, lease papers etc)?
My fiancee is a divorcee but the divorce deed was executed before the notary. Her brother says, he consulted some lawyer who said the divorce is valid.
