Legal Question in Family Law in

my wife file case under section 13 of hma in 22 nov 2008 . i filed case under section 9 of hma in 21 jan 2009. in section 9 case , only her cross examination pending but in her section 13 case , yet issues has not being decided. now she gave application under section of cpc 10 for proceeding stay in sction 9 case for basis that`her` 13 case runned prior to section 9 case . how i defend this application

section 10 CPC will not apply in the two petitions. Both section 13 and section 9 applications may run simultaneously. The two actions are not suits so as to fall under section 10 cpc
