Legal Question in Family Law in India

My wife filed a case under sec 26 HMA for custody of kids without any other case pending in court either maintainence(sec 125),divorce(sec 13) or restitution of conjugal rights(sec 9). Best part is the case no was allotted when the court was vacant. Then after 6 months the court sat and then we filed an application to cancel the case on maintainablity but the judge gave another 3 months date. Is the case maintainable and what should be done next.

custody case can run independently and there is no need to file any supporting case as mentioned above.
