My wife and I have filed the first petition for divorce on mutual consent grounds. What happens if one of us does not agree to file the second petition?

It all depends upon the facts of each case. Under normal circumstances, the petition fails.

then the divorce would not be granted and second motion, even if filed, would be dismissed.
