Legal Question in Family Law in India
My wife has filed the restitution of conjugal rights in 2008 after she left the house.I agreed for the restitution of conjugal rights.
But she did not return back and She dragged the case for two years and finally
she withdrew her petition 2011 as not pressed.
After she withdrew the restitution of conjugal rights case she has filed the maintenance case of crpc 125 in 2011 and application for interim
maintenance by saying lot of false allegations against me.
The court ordered for interim maintenance for 6000 per month.
So She is dragging the main case for getting this interim maintenance.
She is not filing the evidences and dragging this case.
Now in 2014 she had filed divorce petition by asking huge permanent alimony under section 13(1)(1A)(1B)
1,Whether i have to file the restitution of conjugal rights case from my side?.Is it good for my case?
2,How to speed up the maintenance case?.

do you want her back?? if not then why file for conjugal right.contest the divorce case.for the 125 petition object to the court about nonfiling of the evidence by her.
