my wife filed suit for dawer and custody of three daughters, not claimed maintinance
after the period one year living in her parent house and she left her three daughter.
during case i also filed suit for conjugal rights .
she during case taken dawery articals through court and withdraw the right of custody of minors but visitaion was allowed.
she claimed that she was divorced by one Talaq in presence of husband mother, brother and her wife.
all three witnesses were examined as court witnesses but mother and brother of me denied only brothers wife admitted one divroce.
and on her statment the court orderd and conferemed divorce.
my question is that is it a divorce by way of one talaq in light of sharayat and law.

yes... iddat period of 90 days start from 1st divorce... On the expiry of that Iddat period it becomes talaq if sex is not done within these 90 days... For more consult [email protected]

Brother Salam has rightly answered but till the extent of talaq on the basis of one talaq, but regarding sex within 90 days there's no condition in Shariah for sex, if husband says openly before two witnesses or to his wife directly that I reconcile before expiry of iddat period it would be considered reconciliation after one talaq.
