Hi,

My wife has left the house on 3rd august and the she went to punjab and did the complain in the punjab women cell against me and my parents. We visted punjab and compromise with her and finally decided i will take a rented house and stay togather and i can take my baby once in a week to my parents. I have rented the house and i called her up she didn't came to me . she called me up and told me that she dosen't want to cme back and she will give me divorce if i return all her things back to her and i agreed to pay all her and my baby insurance policy. But after taking all her things she and her parents stop taking my calls. Finally i complain to women cell in mumbai to call her and do the councelling bet both of us but she didn't came there. finally i gt a court summon from navi mumbai court of CRPC 125. I have visited the court as per the dates given and also replied to her summon but she was always absent.mean time i also put the restitution of conjugal in family court bandra and she is nt visiting there also. Sir just want to know can i request the Navi mumbai court to dismiss CRPC125 case on me and handover the case to family court. If yes can you pleased let knw wht should i write in the application.

Whether under 125 Cr P. C or under HMA / H.A.M.A. you will need to pay her maintenance. Better you start sending her sufficient money for herself and the child. Legal recourse may complicate the situation. RCR may not help. You may stay cool and wait for some more time for settlement. Meanwhile, start making payments without waiting for any order under 125.
