Legal Question in Family Law in India

My wife has left the matrimonial house since 10 month along with my son (age approx 4 years). There is no legal case / complain so far. But she is not ready to come back. Also she does not allow my son to come with me for few days. I have been requesting her and doing my best to restore this back to normal. I am very attached to my family specially with my son . I am very depressed and upset about this. She has admitted my son in school without my consent and joined job and staying with her brother. I am not sure what needs to be done.

1) Please advice me if I need to take some legal action or lodge a complain?

2) I want my son custody atleast, if she refuses to come back, for which what shall I do?

you may file a petition for custody and visitation rights.
