Legal Question in Family Law in Pakistan
My wife is asking for her Meher and Gold (written as gift in nikah nama) from my side, in order to come back and live with me, under the restitution of conjugal rights case, which I have filed on her.
But actually I do not believe her.... So, I think, even if I give these items to her in court, she may still refuse to comeback and ask for Khula instead... or come back for just 1-2 days and then go back again.... and ask for khula.... Currently she is not asking for khula but her maintenance expense because she knows that in khula she will loose the right to meher, gold, etc... So, she is demanding these things first.
So, can anyone tell me, if I give these things to her in the court... and then she refuses to come back at a later date and ask for khula.... Can I get these items back from court?? I mean Gold gift and Meher (BOTH)?? I mean are these Returnable in case of khula?? Or they'll be lost forever??

bridal gifts can only be claimed through civil suit for recovery and doest fall under family law preview. if the property given other than dower can and will be returned to husband in case of khula .
