Legal Question in Family Law in India
My wife has son from previous marriage. we have just married & she was independently raising her son for last 12 year after demise of her first husband ( within a year of child birth). But, just now as she got married with me , her previous ' in-laws" put a plea for child custody (only grand mother alive) on the basis that she has remarried. further, we agree to her right of visitation but she is insisting on sending the child to her home for few days but we are not agreeing on same as we are living in different cities and she herself is dependent on someone/ relative and those relative have vested interest on same. Further, said relative is judge and is influencing the judgement and we are being pushed to corner. can we transfer case to different state? What we should do ?
