Legal Question in Family Law in Bangladesh

My wife had suicidal tendency and had attempted to suicide twice before marriage and before we knew each other. We have been married for five years and nothing of this sort had ever occurred. But Now we have a child. Recently we had some disputes and now living separately. She is a great mother but now she gets very crazy these days. I asked her to take our child and come to my house but she refused to do so. My question is what rights do I have on my child? Can I claim custody still being married? And what are the chances of my getting custody? I am financially sound and socially respected. We all are Bangladeshis .

If husband and wife stay separately, law allows mother to retain boy child till the age of 7. However exception may be there. Your case will come to that exception if you can show that due to problemetic mental attitude your wife's attachment is going to endanger your child's future. Though it is difficult but seems not impossible in your case. For that you have to go to court. No matter whether marriage subsists or not.
