Can a woman file 498a IPC against husband and in-laws once a joint petition is pending in the Family Court for 5 months?

in case the joint petition is pending for mutual consent and in the affidavit it is mentioned that both the parties will not file any case pertaining to marriage, even if woman files the same, it can be quashed if the mutual consent petition is still pending.
