Hi I am a working lady recently I am living separately from my husband due to his bad manners and physical abbuse.i have a 5 years old son and a 5 month old son. I am victim of physical abuse for many times but considering social status and my sons future I never report any GD in thana. Now things are getting worse and I have now decided to file a GD, get a medical certificate so that I can get full custody of by both sons. Plz advice what should I mention in GD, as I am doing GD now so will it be valid as abuse happened 6 month before, if now I don't allow my husband to meet my sons what legal action should I take? Can I also go abroad for study with my kids.?

Hello, Please note that you should file a GD as soon as possible and you should mention in your GD about your husband's bad attitudes, mistreatment, the physical and mental torture which you suffered and now you feel unsecured due to your husband's mistreatment. It will not be invalid to file GD now even though you suffered physical and mental torture 6 months ago. However, you should mention in your GD that still you are facing problems with your husband and must mention in details about the problems.
You can file a civil case for sole custody in the court if you don't want your husband to meet your sons.
As you are the natural mother of your sons, you can go abroad for study with your kids provided that there is no legal action against you (such as restrictions to take your sons in abroad) taken by your husband.
