Legal Question in Family Law in India
From last one year, my husband has been severely torturing me - beating me brutally, verbally abusing, using extremely bad slang for me and my family members, everyday. Also harasses me for dowry. My family has tried hard to resolve the issue by talking with him and his family. But nothing worked. I cant bear his credulity anymore.
I have come to my parents. Now he is ready to take me back (like every time). I want to lodge an FIR and file a divorce later. There is not much evidence of his misconducts except hearsay.
I have told him, if he wants me back, he must write an apology and mention all his wrongdoings in a affidavit stamp paper as an assurance, that he wont repeat these things again.
How effective an affidavit is (as an evidence of misconduct) ?
Can I furnish the affidavit in court as the evidence of his misconducts?
