Legal Question in Civil Litigation in India

My aunt who was not married died in Nov 2013. She owns an apartment in Malleswaram , Bangalore . She has written a will ( which is not registered ) authorising her 4 siblings living in Bangalore to dispose off her movable and immovable property . She has a Maruthi van which the siblings want to donate it to driver who looked after her well during her last days . When we applied for transfer at RTO , RTO wants Jeevantha Kutumba Sadasyara Patti ( survivor certificate ) from Tehsildar . When we approached Naada bhavan at Rajajinagar they informed that this will be given to only govt employees . How do we proceed now as My aunt did not work in Governament.

Legal heir has to obtain legal heir certificate from Tehsildar. Then only can he dispose of the property. You should apply to Tehsildar. Call for more help--

Dear Sir / Madam,

If I recollect, I have replied to this query before. Still I will repeat what I have stated earlier. Although a Will need not be registered, it has to be probated by the Court, for the beneficiary named therein to acquire title of all the assets of the deceased as contained in the Will. On the strength of the Will, you may alternatively obtain a Succession Certificate from the Court and proceed ahead.
