Legal Question in Civil Litigation in India

Hi my dad has no income and depending on his son but he is not in a position to pay the way the lawyers ask him to. The issue being, my dad has a site in Bangalore but a person and a bank illegally auctioning it very shortly. We are running out of time and there are no results yet.

In the Property sale chain or the EC the person's name is not there who has taken loan on my dad's property. He has never been the owner of my dad's property till date. The bank is involved in fraudulently passing the loan to the fraud person. It seems like the bank and the person who took loan are together involved in this fraud case. We have only 5 days including today the 02/07/2013. We are looking for help because if this property is gone we would have no place to stay. It�s my dad's hard earned money (life�s savings). Please suggest me the procedure to save our property. My dad including family is suffering from sleepless nights and mental depression.

Dear Sir / Madam,

Two scenarios emerge from your query. If you are the son, and your father is wholly dependent on you, the lawyers are nobody to decide how much your father has to pay you towards his subsistence. If you are the daughter, and your father is dependent on your brother, they are to mutually decide in the matter.

Now coming to your father's development site in Bengaluru (which you are worried that your family will lose) the bank also may be concerned about the settlement of the loan taken by your father in the project, and hence the bank may have initiated proceedings against your father. You will need to provide additional security to prevent the bank from hastening its recovery process.

Unless and until, you have firm evidence, it is incorrect to presume that the bank and the purchaser have fraudulently colluded with each other.
