Legal Question in Civil Litigation in India
My father had a property (a house with some land) in Kolkata, Westbengal. He is no more alive. We are 9 brothers and sisters. One of my sister, who is still alive, wants to gift her portion to me. What's the legal procedure of getting that portion as gift and how much would be the stamp duty and registration charges

Dear Sir / Madam,
If your deceased father has left behind his Will, the property vests in the name of the beneficiary named in your father's Will. If your father has died intestate (without a Will), the entire property vests in the name of your mother. The legal heirs (sons and daughters) do not come in the picture as regards their legal right in the property, till your mother is living.
