Legal Question in Civil Litigation in
we are an hindu family comprising of my widow mother , three sisters & one brother ,all are married. my father expired last year. my mother staying alone. my father didnot write any will except one plain paper where he wrote some distribution about one of his property that too without signature.
we want to know daughter's legal rights for property share as per indian civil procedure code.
kindly advice

the piece of paper without signature cannot be considered his Will. Will has to be executed by the testator and witnessed by two persons. so in this case there is no will. Your mother, brother and sisters, all will have equal share in the property under the succession law.
the paper cannot be a will.equal share under Sucession Act and not under cpc.
All of you are entitled to equal share.
