Legal Question in Civil Litigation in India

My mother has given her land equally to her four sons each 800 square feet by settlement deeds. Each son has below the required plinth area for applying building license from corporation. Hence three sons join together applied for license to build in 2400 sft (800X3) and got building license. Fourth son could not get the license since the plinth area is only 800 sft. In this situation can the fourth son file a suit against the corporation for providing license to three sons and ask to cancel the same?

Yes, the fourth son has the right to sue, since he is at par with all the other three brothers as regards the land.
