Legal Question in Civil Litigation in India

Respected sir,

We are three brothers, iam the eldest, in 2002 we purchased a property in joint name of myself and second brother, that time my father was alive and 2007 he died, we also built house taking housing loan on joint name, now at 2002 the youngest as he had done diplome in civil construction,we thought why to engage a contractor as he was looking after construction,he supervised building construction, we all are staying together, after his marriage differences cropped up,general thought was that as every one was staying together, general feeling that though he is not legal owner of the property, if any share will happen in future, it will be shared equally. he is not paying EMIs of the house nor the property is in his name, now i want sell off the property, but he is also asking his share, what is the best solution for the problem, since we don't want to hurt feeling of my mother who is still there with us, is there a solution pls advice
