Legal Question in Health Care Law in India

Is there a law by which I can complain against the charges by a private hospital. I recently had to undergo a hand surgery at Sahara Hospital. The surgeon charged me Rs.30000/ and the anasthesiologist charged 7500/ for a 2 hour operation in addition to the cost of various hospital facilities like ward charges, operation theatre charges, ICU charges, nursing charges and consumables charges. These may vary from hospital to hospital but can a doctor charge his fees as per his discretion for a specific surgical procedure. For eg. can a doctor charge Rs. 1000/ for OPD consultation when the rate is 500/ for M.Ch., D.M. qualified doctor.

I want to know whether the government prescribes charges for various surgical procedures? If any doctor charges more fees for a surgical procedure or OPD then is there a law which protects the consumers against exploitation by doctors.

you may write to the hospital itself and challenge their charges. If you feel aggrieved you may approach the consumer forum. Try to take the comparative charges of other hospitals too. then send a RTI and find out if the doctors are bound by any regulations of the fees they take.
