Legal Question in Immigration Law in Philippines
I have a boyfriend who happens to be a US citizen and we lived in one roof for sometime and everytime he's here for a vacation. He wants to petition me but I am still married technically to my former husband who also has a family of his own now. Since we cant afford an annulment, we agreed upon a notarized memorandum of agreement. Would that help in processing my fiancee visa? Please advise.

To qualify you for a fiancee visa, you must have a legal capacity to marry your US Citizen fiance. A notariizal memorandum of agreement between you and your husband will not give you legal capacity to marry your boyfriend. You will remain married to your husband and such being the case, you will not qualify for a fiancee visa.
