Legal Question in International Law in Netherlands

Dear Sirs,

I'm contacting you second time because i'm afraid i haven't gave you all informations regarding my problem.

I'm contacting you from Zagreb, Croatia.

Last Friday, 6. of December, I've received a call from a lawyer from Rotterdam, Netherlands, saying that my common-law spouse, Croatian citizen, was arrested and that he is in jail.

The lawyer couldn't tell me why is he arrested or give me any information about it. We spoke again this Monday, 9. of December and he still couldn't tell me reason why my common-law spouse is arrested and is being held in jail.

He said that the restriction he has about giving any information to the third party regarding my spouse's case could be removed by the end of this week. I am aware that this is the regular law procedure in Netherlands.

Regarding that, i wold like to ask you following questions;

How long does the period of restriction usually last, is it normal that periods of restriction are this long for minor criminal cases or are longer periods of restriction reserved for more serious offenses?

How long can police hold him in custody before he gets a lawyer and before they notify his family? For example, could he have been arrested on Monday and I have been informed about that on Friday?

Than you in advance

Dear Madam,

I refer you to my previous answer:

In the Netherlands, when a lawyer is called to assist an arrested person, he will lways be told what the charge is. And the details will be available some hours later.

The law in the Netherlands states that a lawyers needs to be present during the first interview with the Police. So the lawyers knows immediately what the charges are.

Our firm regularly visits arrested people in jails all over the Netherlands.

So if you need assistance, feel free to contact us on: Law (at) LL2 . be
