Legal Question in Employment Law in India

Hello,

My condition is that as per contract with educational instituteI have to give 2 months notice period. I had given Intimation to Resignation letter and I was been told verbally that to end with in a week as semester was over and notice period will be in vacation time. Now institute is not giving last month salary stating notice period criteria. And I was well informed to HOD verbally about the resignation. Can I take legal action? Please help

Dear Sir / Madam,

Yes, you may take legal recourse but your case is quite weak. After the semester is over, moderators have to spend time assessing and correcting all the examination papers of the students, in which I envisage a minimum time of 15 (fifteen) days to go by. Secondly, the educational institution is liable to pay you at least a month's salary for the period of one month you worked in the institution from the date of your resignation. I suggest you amicably resolve the matter with the institution and request the Principal to provide you with your Service Certificate.
