Legal Question in Employment Law in India
Dear Prashant Sir
The recovery suit for service agreement is 2 lacs and notice period is 75000.
Total recovery suit is for 275000.
Would you recommend a good & budgetary lawyer in faridabad.
I will share the judgement copy when i will get it.
In appointment letter & during interview it is said that you may be sent abroad for training. But in agreement it is changed to "on job training "
The judgement is not uploaded yet.
on internet i have checked case status where it is mentioned "Nature of Disposal : Contested - - decreed with no costs "
my lawyer says that it means we have lost the case.
The total amount to be paid to company is stated in judgement / decree sheet.

Dear Vicky,
Don't jump to any conclusions till you receive the Judgement Copy because the preliminary verdict announced is inclusive. "Decreed' means official order with the force of law and not won or lost. As I said earlier, such cases are argued on behalf of the employee and are won citing only two wrong doings by the employer - A service or employment bond of any form or nature for whatever reason or grounds implies bonded labour which is against the principal of natural justice hence illegal and a criminal offence. Secondly, even if the grounds stated by the employer are for "training", it is imparted for the benefit and gain of the Company more than the employee. As stated, your case may not have been argued properly and has been messed up. Keep out an Advocate. Represent the case yourself in the Court.
