Legal Question in Employment Law in India

Dear Sir,

Good Morning. Sir, I need your kind advise on my employment related issues. Myself & my sister working at Tecpro Systems Ltd. Where last one year company not yet paid my monthly salary, not deposited PF, Gratuity, Super Annuation, IT etc. Always they are saying that company will get the money from bank/clients/ through CDR etc but ultimately they failed to clear the dues. Management says that if they receive payments then only they can release dues. Always they failed to clear govt statutory/ vendor payment etc. Even they says that they are unable to clear anything. Last week only 50 out of 200 employees get one month salary & management says that others will not get their salary. If anyone shouting they have been transferred other site. We are totally helpless at that moment & unable to run my daily family expenses. If we want to withdraw our PF then company asking to sign no due certificate as well as signed deceleration not to go for legal action. Our all dues company going to invoke. Sir, if any further details required kindly email me, i can send you all details. I am the only earning member in our family, total 6 members dependent on me.

Dear Sir / Madam,

You are unnecessarily wasting your valuable time attending Office when the Company is not paying you your dues. You and your sister should immediately submit your resignation and ask the Company to pay up and settle all your dues. If the Company fails to settle your dues, straightaway lodge an FIR for cheating against the Company in the local Police Station furnishing all the details. Take up another job at the earliest.
