Dear Sir,

I have resigned from a nationalised bank after serving for 3 years as officer.

I have tendered my resignation on 07.06.2010 along with 3 months salary submitted through Demand Draft with a request to accept the same with immediate effect. I have also stated therein that I have got a better offer of appointment in another Govt. organisation wherein the last date for joining was given as 14.06.2010.

But the Bank has not given any reply on the same retaining the letter and the Demand Draft with them.

As per employment offer of the Bank, my services was terminable by 3 months notice or 3 months salary in lieu thereof.

However my new employer was seeking relieving letter for which I asked them to give me an extended period of joining for one month. Accepting my request, they have extended last date of joining by 1 month i.e., upto 14.07.2010.

But even after lapse of considerable time, no reply/ communication/ acceptance/ relieving was given by the Bank. So I again wrote a letter on 09.07.2010 to bank stating therein the extended date of joining and that I shall consider the non communication as acceptance of my Resignation letter.

On having not received any communication from the Bank till 14.07.2010, I approached the new Employer submitting the proof of my resignation letter, payment of 3 months salary, and my offer of appointment from bank stating the terms of termination of services. The new employer agreed to join the the organisation and thus I joined the same on 14.07.2010.

Now on 01.08.2010, I came to know from my previous colleagues that my resignation is being refused by Bank stating that I need to serve for 3 months in the bank and Had I join any other organisation, Action shall be initiated against me.

Now, I am totally frustrated and confused as to what should I do?

You are requested to kindly guide me what can be the implications of this situation and how can I safe guard myself on this. Please reply on earliest. Thanking you in anticipation.
