Legal Question in Employment Law in India
Dear Sir,
I had worked National Hydroelectric Power Corporation (Government of India Enterprises) Mini Ratna Company as junior Engineer from 2004 to 2006.
for 2 years NHPC not forwarded the application for other organisation as per its company rules.
In 2006 I applied through proper channel and obtained NOC from NHPC for post of Assistant Engineer at Hindustan Aeronautics Limited, Nasik (Ministry of Defence Undertaking) Navratna Company. Subsequently I resigned NHPC on 20-12-2006 and joined HAL on 30-12-2006. My Increment Due on 01-01-2007.
I requested for pay protection
HAL protected last drawn basic pay. But increment is not protected.
I had lost one increment due to joining in December month.
If I resigned in January and joined in same month increment is automatically protected.
Somebody told me that if application is forwarded through proper channel, NOC obtained from the previous employer and increment is due within 3 months then the PSUs / Central Government shall be considering the increment while pay fixation
They are referring FR22 1 (a) I Government Order

Dear Sir / Madam,
Although you have lost one increment, do not brood over the past. Look ahead and focus on the tasks assigned to you at work and complete them to the best of your ability. As I see here, proper channel means your immediate superior and the HR Department who conduct your performance appraisal.
