Legal Question in Employment Law in India

My name is Dharmender,I was worked in company from Last One Year(June 2012 to July 2013), whose name is roto power project pvt ltd. (Gurgaon)

and query is that i was trying to got my appointment\joining and ESI letter but they are always negotible,after all i resigned the company without any notice period coz i dont know about company policy,coz i have not any joining letter,whom i know abt company policy,But i have all monthely salary Slip,all Incoming\outgoing mail,PF Data,so now company would not like to give me my full and final and also my PF,

so pls help me what do i do

Without a joining letter, it is difficult to establish that you were a regular employee. Pl collect all available documents (emails, salary slip etc) and consult an advocate for taking legal action.

Dear Dharmendra,

If you have resigned from the Company without serving the required notice period, the Company is supposed to recover the notice period salary and settle your dues. If they are not doing it, you should file an FIR against the Company in the local Police station. Please re-post query if there is no Police action within 3 days of your lodging the FIR.
