Legal Question in Employment Law in India
I am in difficult situation here in my current organization. My resignation is not getting accepted by my manager and the HR is also involved in this. I am willing to server full notice period but manager due to personal grudges is not accepting my resignation and saying he won't relieve me. I am not able to join without relieving and experience certificate in new organization. please advice.

Dear Sir / Madam,
Once you submit your resignation, it is legally binding upon the Company to relieve you from service at the end of the notice period as mentioned in your Appointment Letter. There is no such terminology as "acceptance" of resignation ... the employer has to accept your resignation. You should serve the notice period and straightaway ask for your Full and Final Settlement on the last working date. If the Company does not settle your dues on the last day, simply lodge a Police complaint for cheating against the Company.
