Employee has resigned, ready to pay notice period waver for 3 months, company not willing to relive early

Dear Madam / Sir,
When an employee resigns, he remains liable to serve or buy out the notice period, and the employer remains eligible to adjust and recover the salary (basic pay only) for the notice period not served by the resigned employee and to settle his / her dues on the last working date.
