Legal Question in Employment Law in India
If an employer does not honour the employment contract and relieves an employee without notice period or notice pay what action can be taken against the employer? Employee contract stipulates two month notice period or notice pay on either side at the time of leaving the employment.

Dear Sir / Madam,
Non-performance and non-fulfillment of any terms and conditions of the Employment Agreement by either party - the Employer or the Employee, being a contract violation by the defaulting party, depending on the nature and circumstances, may come under the meaning of "cheating' as per Section 420 of the Indian Penal Code.
