Hi Experts,

One of my Family mate was recently died in a accident and as a compensation his Government job was allotted to his wife,but now she is planning to have second marriage and not accepting the dead man mother to offer his pension amount even and my question how can she continue in job of her first Husband as her status will change from Widow to Married as she gets married and how can we help his mother to get benefits without going into hands of this lady(wife)your help in this regard saves a life of an old lady so please reply on humanitarian grounds

Dear Sir / Madam,

Although I have answered this query earlier, I will answer it again. The wife has got a job in the concerned Government Department as a result of her husband passing away in an accident. The pension amount of the deceased will go in the name of the nominee filed in the Government Department record by the deceased. If the nominee is the mother, she remains entitled to receive the deceased's pension. If the nominee is the wife, she remains entitled to receive the deceased's pension. Emotions, feelings and sentiments have no place in law.
