Legal Question in Employment Law in Philippines
Good Day! I am working for this company for 2 years and is about to close down in less than 30 days. Couple of weeks ago we were told to look for other opportunities because he has no funds to pay for our salaries, and our last salary that we will receive is Nov 28. meaning yung mga pinasok namin for the next cut off and supposed to be released on dec 12, and the remaining days are "TY" and we also have no 13th month pay. He promised us that we will receive severance pay after he had collected payments from the remaining projects...(we don't know when) no 13th month pay mentioned in the letter. the owner of the company who is responsible is in Canada (but he is Filipino, he just migrated) and we are not sure when he will go back to the Philippines. we posses 2 computers, & 2 printers from the company at home because before he left he sent us home for a work from home set up. Are we still entitled for 13th month pay? Tama po ba yung ginagawa nung boss namin na nasa Canada? No 13th month pay and no salaries, kasi "mga sinuswerte 'daw' kami, at ang saya saya 'daw' namin dahil wala naman kaming ginagawa"

File a case before the NLRC and report him to the BIR
