I am Maryse Barnachea and I just have a question regarding my friend's employment. He rendered 8 months in his company as an Estimator and Site Engineer. Nung sinabi po na tanggap siya, nagreport po siya sa office but they only asked him his requirements and he asked for a contract, ang sabi lang po sa kanya ay 6 mos po ang probatio nila and may 3 mos na training. He asked yung nagrefer sa kanya ang sabi po wala daw po sila talagang contract, hindi na po siya nagtanong kasi even yung immediate supervisor nya wala din pong contract. Binigay po niya sss number and he asked if sila magpproces ng philhealth, sabi nila wala daw pong ganun pag naregular na daw po. 426 po ang sweldo nya per day plus 20 pesos na cola. Pumasok po siya dun October 29,2012 and until magresign xa ganyan po ang rate pero sabi sa law effective nov 1 2012 ay dapat 30 pesos na ang cola. After 2 mos sa office, January of 2013 he was assigned sa site in Pasig, dapat may allowance na siyang 1800 a month pero hindi nila binigay until magresign siya and sabi ilang months pa daw bago siya mabigyan whilst yung mga bago meron na po agad. May total of 15 days din na nakaltas sa sweldo nya pondo daw po yun na makukuha nila pagresign. And last year hindi po siya binigyan ng pro rated 13th month pay kahit lagpas 1 month na service nya by December. Nagkkasakit po siya last May and he filed a week of leave para makauwi sa La Union, there he was diagnosed with asthma adn can no longer do strenuous activities and di dapat mapagod muna and maexpose sa usok and alikabok. He filed an immediate resignation last May 20 and signed by his PIC sa site. When he report sa HR para po magclearance, sabi po sa kanya na kapag immediate ay hindi ibibigay ang pondo, last sahod and COE. Which is so unfair. He explained and presented the medcert and wala po silang pakialam iyon daw po ang rule, so nakiusap po siya na kung pwede sa office nlang as estimator, pumayag po sila. Due to travel and stress may mga absents po siya and he was able to attend mga 6-8 days po kasi minsan halfday siya sa office at dun po siya sinusumpong. After June 20 he asked po about the back pay/pondo. Sabi po 1 week. After a week di pa daw po nacompute. After a week again sabi 6 days lang po ang pondo niya, may mga payslips kami na hawak though 8 days lang ang total but when the company lost their payroll dati hindi na sila nagbibigay ng payslip though how hard they demanded and kapag kinocompute ay natatanggalan parin siya ng pondo. And yung allowance sa site sabi hindi po siya bibigyan nun dapat daw po ilang months pa siyang magwork sa site which is so unfair! Yung sumunod sa kanya 1 week sa site may allowance na, he raised it sa PIC nya but walang nangyari, maybe 2, 3 times nya sinabi wala parin. Now he is planning to go sa NLRC po. We have IDs, copy of payslips, project passes, his payroll atm and he will try to get the copy of his clearance and resignation letter. Ang fear lang po niya is baka po madeny ang kanyang employment kasi wala po siyang contract. Ano po ang pwede po naming ikaso sa company na yun. They cant pay him pero multi million ang projects nila at walang mandatory contributions.... Please Help po and more power!
