Legal Question in Employment Law in India

Hello,

We were employees of a limited company in India, we hve resided in 2004 from the company as a part of prunning but payment of Gratuity and other benefits like LtC pending Salary for 1 months etc are not paid by co. In between the company has been wound up by Liquidator Kolkata Cour, now after 5 years of time, liquidator has issue payments to some running employees and some outside creditors but payments of the resigined staff not made even it has been confirmed by Liuquidator in writing. As per our knowledge, we, the resignedstaff should, bet the payment at first than any other creditors alongwith interest, isn't it true, So what action we have to take to get the payment from Liquidator? We haveso far not written any letter to Liquidator or Court, Ofcourse we have received 2 letters from Luqiidatory in their letter head confirming our credit at Com. and sanction the payment.. Please suggest us what to do further.

No. Settlement of employee dues in case of liquidation is done only after all external debts and liabilities have been fully repaid and settled.
