Hi
I am working in a company for last 7 years in kolkata (West Bengal)presently i am looking for a change, according to my company management if I put resignation then my company is not liable to pay my gratuity according to them if they terminate and I retire then only company is liable to pay my gratuity.
kindly tell me what is the law

Dear Sir / Madam,
The rule is that the Company is liable to pay / transfer the Gratuity irrespective of whether you resign or the Company terminates your service i.e on leaving the Company.
