Legal Question in Employment Law in India
I have joined a private ltd company in April 2013 in managerial cadre on probation period of 1 year, which was later on extended by 6 months October 2014. In the appointment letter it is said that during this period, if I resign or they terminate me notice period of 3 months needs to be given. I was terminated on october 2014 stating poor performance. I was asked to tender my resignation and was not allowed to attend the office. 18/11/2014 they are conveying that since they have terminated me during probation they will pay only 1 month's salary. They have not given the final settlement amount or relieving letter yet. What options do I have

Dear Sir / Madam,
In keeping with the terms and conditions of your Appointment, if the employer terminates your service three month's notice is required or salary in lieu thereof. You are entitled to three month's notice pay along with your full and final settlement dues. If the Company fails to pay you the amount, simply lodge a Police complaint against the Company for cheating.
