What is the minimum period of service for payment of gratuity- 5 years service or 4 years 240 days.
I have completed 4 years 11 months continuous service in an organisation in India and they are denying the gratuity due to not completing 5 years. Am I eligible for gratuity

Dear Sir / Madam,
The minimum period of service for payment of Gratuity is completion of 5 years service, But Gratuity to any employee who has completed more than 3 years service or more is left to the sole discretion of the Company Management. You are not eligible for Gratuity if we go strictly by the rule book. You should make a request to the Board to consider paying you Gratuity, if they pay well and good; if not, just forget about it.
