Legal Question in Employment Law in India
Please note that as per Section 66 in The Factories Act, 1948, no woman shall be 2[ required or allowed to work in any factory] except between the hours of 6 A. M. and 7 P. M. Provided that the State Government may, by notification in the Official Gazette, in respect of 2[ any factory or group or class or description of factories,] vary the limits laid down in clause (b), but so that no such variation shall authorize the employment of any woman between the hours of 10 P. M. and 5 A. M.
My question is, is this clause is applicable for only women in labour class or is it also for women in management class.
As we work in oil sector depots/ installations under management cadre and we comes under factory act so will this clause be applicable to us???

Dear Sir / Madam,
Section 66 clearly states the permissible timing for women to work in any "factory" and does not include management office staff in it. It is specifically applicable to workers only. For instance, female employees work in night shifts in BPOs which is permissible. Management cadre staff do not come under the provisions of this Section.
