Legal Question in Employment Law in India

OFFICIAL TIMING IN XYZ LIMITED OFFICE IS 10:25. ACCOUNTANT OF THAT COMPANY IS COMMING AT 10:50 TO 11:30 IN MOST OF THE DAYS. BUT, IF ANY STAFF COMES LATE HE IS ASKING HIM FOR NOT TO DO WORK FOR THAT DAY, AND ORDERED THE TIME OFFICE TO MAKE HIM ABSENT AND DEDUCT HIS ONE DAY SALARY. NEITHER ANY NOTICE REGARDING TIMING OR SALARY DEDUCTION IS ISSUED BY THAT COMPANY NOR ANY RESOLUTION PASSED. THEN HOW CAN HE ASK TO DEDUCT ANY STAFFS SALARY OR MAKE HIM ABSENT ? IS HE RIGHT IN HIS DECISION.? PLEASE SUGGEST WHETHER THE MATTER SHOULD BE INFORMED TO THE MD OR NOT.

Dear Anindya,

Before I reply to your question, I would like to cite a few business maxims :

2. Your example is more important than your advice.

19. People who "play office" should go back to kindergarten.

29. "Work done with little effort is likely to yield little results." - B C Forbes

30. It is easier to get forgiveness than permission.

39. Never treat your subordinates as inferiors.

42. Corporate bullies create corporate turnover.

46. It isn't the people you fire who make your life miserable, it's the ones you don't.

52. A career should be a quest not for perfection, but for a high batting average.

54. "Motivation comes from the significant principle : Everyone wants what he or she does to be significant. Make it true and make them believe it." - Tom Oliver, Executive President, FedEx.

55. When you find you don't love your job, look for another.

87. Don't blame others for your errors. If you're responsible, take the hit.

118. Demand excellence from every employee ... including yourself.

120. Come to work at 06.00 am and leave at 08.00 pm at least once a month.

121. Remember all who were working at 06.00 am and 08.00 pm and give them a raise.

122. If no one is ever at work at 06.00 am or 08.00 pm, your Company is in trouble.

123. Resist giving your bosses advice. Offer suggestions that allow them to reach the same conclusion.

126. Never cry.

142. "Only the fittest will survive, and the fittest will be the ones who understand their Office's politics." - Jean Hollande

178. When you need to speak directly to your MD, call his Office before 08.30 am or after 05.30 pm. Chances are he'll / she'll pick up the phone himself / herself.

The Accountant is supposed to adhere to and follow Company policy regarding "late coming" to Office as instructed by the MD. Employees are required to adhere to and follow the terms and conditions specified in their Appointment Letter. As mentioned above, although the Accountant should set the precedent of coming to Office on time ... and only then does he / she have the right to question others who do not report for duty in time ... there will be instances when the Accountant too is on outdoor duty and not in Office. You also need to bear in mind that technology enables Company executives and staff to follow "flexi-timings". In my view, you may report the matter to your MD iff you do not directly report to the Accountant.

Regards,
