Legal Question in Employment Law in India
A person convicted by lower court under IPC 420/470......but no proof was given that he had done it.....was terminated by municipal corporation. The person appeals is pending in session court.
Is the person not eligible of his provident fund till his terminated date. Can the corporation withhold the provident fund...
Please give advice

Dear Sir / Madam,
Yes, the Municipal Corporation is right in withholding the Provident Fund of the terminated employee till the suit in the sessions court is decided or dismissed.
