Legal Question in Employment Law in India
I am a PRINCIPAL of a purely private PHARMACY COLLEGE. In the SERVICE RULES of our College of there is no provision of Gratuity. In spite of that one of the retired Asst. Professors has filed a case in the labour court claiming Gratuity. 1) Do we come under the preview of INDUSTRIAL ACT? 2)Are the Private Pharmacy Colleges bound to pay GRATUITY?

Dear Sir / Madam,
The Private Pharmacy College has to provide for one half month's salary for each year of completed service as Gratuity for all those employees who have completed 5 years service.
1). YES, you come under the purview of the Industrial Act;
2). YES, you are bound to pay Gratuity to the eligible staff.
