Legal Question in Employment Law in India
i given my resignation to my company on 18.01.2014, but they given termination letter to me 07.02.2014. and later they sent me settlement letter in that they have deducted 3 month notice pay as they have terminated me from there side but as per appointment letter it is wrong. now later they said they will issue me a reliving letter in place of termination letter hence the settlement is ok and then i accepted the settlement. but still they are not providing me the letter nor given me the settlement of gratuity also. i am totally depressed, because i cannot get the job because of termination letter. the reason for termination is i have not applied leave in written as i was suffered from jaundice i conveyed them on phone.
what can i do in my case.

Dear Tarun,
Whether you have resigned or you have been terminated, as per your Appointment letter you ought to be paid three months notice pay by the Company. Do not tell any of your prospective employers that you have been terminated. Say that you resigned from the job. You should write a letter to the Company to immediately release all your dues including your Gratuity amount.
