Legal Question in Employment Law in India
I have resigned from company by giving 3 months notice period as per contract terms. "Contract terms says, either party can give 3 months notice or basic pay in place of it".
Can company ask me to go early to protect their interest in this notice period?
If company owns bonus which need to paid within this notice period (there is a condition that one has to be on payroll on so and so date which falls in between notice period), can they withhold bonus?

Dear Sir / Madam,
Yes, the Company can ask you to leave prior to completing the notice period by paying you salary till the date of completing the notice period. Generally, notice period is not taken into consideration for deciding bonus eligibility i.e. an employee who has resigned is not eligible for bonus if it is declared on or after the date of resignation.
