Legal Question in Employment Law in India
Respected sir/madam,
I am Tarun Yadav. I am Assistant Professor in self financed MBA College.
I was employed in the college in 2005 and have been working in the same college since then. Now I am resigning from the post and I have asked them for gratuity and after evaluating all documents, they are saying that I am not eligible for gratuity as I am not eligible for the post itself.
The matter is, for becoming assistant professor one must possess 60% marks. My marksheet of MBA showed Grade Points. And at that time, I was genuinely not knowing how to convert grade points into marks. I presented them with all my documents, then they interpreted it and selected me.
Now, after almost 9 years of service they are saying that I was not eligible at that time so I am also not eligible for receiving gratuity.
What could be done in this matter please help�.

Dear Tarun,
If your college is a member of a recognized Gratuity Fund, you are entitled to receive Gratuity for having completed more than 5 years in service. Since the College refuses to acknowledge your Gratuity claim, you should lodge a written complaint with the concerned University Registrar requesting his intervention to acknowledge and resolve the matter.
