Legal Question in Employment Law in India

I have served for only 2 months in a company and resigned for further studies. My contract is silent for any probation period. It says for 3 month notice period or notice pay both if employer terminates or employee resigns.

Please advice whether just for 2 months serving, notice period of 3 month is applicable? Which law line in Maharashtra I can refer to HR to save my interest for early release.
