Legal Question in Employment Law in India
Sir, we are a group of j.e. in railway in western railway Ahmedabad division. we were promoted from group d post to group c via departmental exam LDCE quota in 2009. In this post we were 48 employee(general-22,obc-8,sc-16,st-2),in final panel. But the initial at time of notification cadre was as- gn obc 40 sc-st 12 and requirement of 3 year regular service.in such case sc st were nil that year,so Sr DPO published another notification for sc st candidates to render one year service. Appearing 68 total sc st fought in merit and got placed as stated above. Now after successing 5 year service present Sr DPO gave a notice of show cause within 10 days how we appear in that exam otherwise to delete our 18 sc st candidates name and back to group d post in same place. Also note that one petition was claimed in CAT Ahmedabad and it is on under procession of judgement. I ask -(1)how only our names delete in a panel why not all. (2)after completed 5 year how they can give a notice directly when a matter is in CAT. Now what should we do?

Dear Sir / Madam,
All the affected employees should jointly submit a written representation to the Sr. DPO stating all the facts and asking that the show cause notice be set aside.
