Legal Question in Employment Law in India

Sir i have problem in resignation..I gave my resignation on 4th Jul and company is not responding for the mail i have sent. I have to join other company in one month after my resignation in the current company. As per the company appointment letter there is no particular date mentioned. Please suggest me how many days is my notice period after resignation as my boss says you should stay 60 days or else your one month salary will be deducted when i personally asked him as he already put a work with his superior.

1) Depends on T&C of employment.

2) Pay salary in lieu of notice if the Company agrees and get relieved if urgent.

Dear Sir / Madam,

The notice period duration as mentioned in your Appointment Letter will prevail. If it states 60 days and you serve only 30 days, you should request the Company to waive off the 30 days notice period not served by you else request the Company to recover and adjust the 30 days notice period salary (basic pay only) from your full and final settlement dues.
