sir i was a registered pharmacist in a retail medical shop my question is one day drug inspector came at medical shop that day i was absent from the medical shop because i was sick and i have a medical certificate issued by a govt md doctor and drug inspector eximined the shop dt 28/11/2011 and found there physician sample not for sale that is " nimusulide" suspension for childern 12 years old, which was banned by bhartiya rajpatra dt 10/02/2011 so i want to know has drug inspector take action against me, if yes so tell me why according to which rule of drug and cosmetic act if no so also tell me that.

Dear Sir / Madam,

The following is the extract of the Drugs and Cosmetics Act, 1948 :

Class of drug prohibited to sale Misbranded, spurious, adulterated and drugs not of standard quality Patent/Proprietary drugs with undisclosed formula Sch-J drugs Expired drugs. Drugs used for consumption by government schemes such as, Armed force. Physician�s samples SJTPC 54

YES, the Drug Inspector can initiate action against you since you are not allowed to store any drugs or medicines which cannot be sold. PS cannot be sold as they are used only by Company sales personnel to promote the product to registered Medical Practitioners only.
